GENERAL TERMS AND CONDITIONS

1. Introduction

These General Terms and Conditions (hereinafter: "GTC") govern the use of the kalozetterem.hu (and pirateempire.hu) website operated by Pirate Empire Kft. (hereinafter: "Service Provider"), the use of the services available online, and the terms of the online purchase of gift vouchers.

The purpose of this GTC is to define in detail the rights and obligations of the Service Provider and of the natural or legal person using the website (hereinafter: "User" or "Customer").

By using the website or by placing an online order, the User declares that they have read and understood the provisions of this GTC and accept them as binding.

If the User does not agree with any provision of this GTC, they are not entitled to use the services of the website.

This GTC is published in electronic form on the kalozetterem.hu website, where it is continuously available and downloadable.

Hereinafter, the above business entity shall be referred to as the Service Provider.

3. Scope of the GTC

This GTC covers:

- the use of the kalozetterem.hu website;

- the online purchase of gift vouchers;

- contacting the Service Provider through the website;

- the use of the newsletter service;

- information related to online table reservations;

- any electronic transaction carried out through the website.

The table reservation service is provided by the Service Provider through an external partner, the Asztalfoglalás.com online booking system. During online booking, Asztalfoglalás.com's own terms and conditions and data processing terms also apply.

This GTC applies exclusively to the legal relationship between the Service Provider and the User, and does not apply to services provided by third parties.

4. Applicable Legislation

This GTC is governed in particular by the provisions of the following legislation:

- Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR)

- Act V of 2013 on the Civil Code

- Act CVIII of 2001 on Electronic Commerce Services

- Act CLV of 1997 on Consumer Protection

- Government Decree 45/2014 (II. 26.) on the Detailed Rules of Contracts between Consumers and Businesses

- Act XLVIII of 2008 on the Basic Conditions and Certain Limitations of Business Advertising

- Act C of 2000 on Accounting

- Act CXXVII of 2007 on Value Added Tax

as well as all other applicable Hungarian and European Union legislation.

5. Definitions

For the purposes of this GTC:

Service Provider: The business entity defined in point 2 of this GTC.

User: Any natural or legal person who visits or uses the website.

Customer: The User who purchases a gift voucher through the website.

Consumer: A natural person acting under the Civil Code who is acting outside their trade, business, or profession.

Website: The kalozetterem.hu website and all of its subpages.

Gift voucher: A voucher sold electronically by the Service Provider, of a specified value, representing a right of payment redeemable at a later time.

Electronic contract: A contract concluded electronically between the parties.

Distance contract: A contract concluded between the parties without their simultaneous physical presence, using exclusively means of distance communication.

6. Use of the Website

The purpose of the kalozetterem.hu website is to provide visitors with information about the services, food and beverage offerings, and events of the Pirate Empire restaurant, as well as to provide the opportunity to purchase gift vouchers, get in touch, subscribe to the newsletter, and initiate a table reservation.

The use of the website in itself does not require registration.

The User is obliged to use the website for its intended purpose and in accordance with applicable law.

The following are, in particular, prohibited when using the website:

- use for an unlawful or unfair purpose;

- obstructing the operation of the website;

- automated data collection or copying without the prior written consent of the Service Provider;

- any activity aimed at circumventing the website's security systems;

- uploading viruses, malicious programs, or other harmful code;

- unauthorized use of the content found on the website.

The Service Provider reserves the right to modify the operation of the website at any time, and to temporarily suspend or develop it for maintenance purposes.

The Service Provider is not liable for damages arising from the temporary unavailability of the service, provided that this is related to normal operation, maintenance, or an unforeseeable technical error.

7. Formation of the Online Contract

Gift vouchers purchasable through the website are ordered electronically.

By placing an order, the Customer makes an offer to purchase the gift voucher.

The contract is formed when the Service Provider confirms the order electronically.

The automatic system message sent about the order only confirms that the order has been received; it does not, in itself, result in the formation of the contract.

The language of the contract is Hungarian.

The concluded contract qualifies as a contract formed electronically, which the Service Provider does not file separately, but retains for the period prescribed by applicable law.

8. Purchase of a Gift Voucher

The website offers the possibility of purchasing an electronic gift voucher.

The gift voucher entitles the holder to use it at the Pirate Empire restaurant up to the value indicated on it.

The Customer is obliged to provide accurate information when placing the order.

The Service Provider is not liable for any damages arising from incorrect or incomplete data provided during the order.

The Service Provider reserves the right to refuse the order in justified cases, in particular if:

- the data provided is manifestly untrue;

- payment is not completed;

- there is suspicion of abuse;

- an incorrect price or incorrect content appears due to a technical error.

If a manifestly incorrect price or other system error causes an incorrect offer to appear on the website, the Service Provider is not obliged to fulfill the order at that price.

9. Payment Methods

When ordering a gift voucher, the Customer may choose from the following payment/collection methods:

- in-person collection and payment at the restaurant;

- advance bank transfer, in which case the voucher is sent to the provided e-mail address within 24 hours on business days following receipt of payment;

- card payment via PayPal, in which case the voucher is likewise sent electronically following successful payment.

Card data does not reach the Service Provider; it is processed exclusively by PayPal.

In the event of technical problems during payment, the Customer may also contact the payment provider's (PayPal's) customer service directly.

The Service Provider does not store card data.

10. Invoicing

Following successful payment, the Service Provider issues an invoice in accordance with applicable accounting legislation.

The Customer is obliged to provide accurate billing information.

The Service Provider is not liable for any damages arising from incorrectly provided data.

The invoice is sent to the e-mail address provided by the Customer or by post.

11. Prices

The prices indicated on the website are in Hungarian forints (HUF).

Prices include value added tax (VAT), unless otherwise stated on the given page.

The Service Provider reserves the right to modify prices.

A price change does not affect orders that have already been confirmed.

In the event of a manifestly incorrect price being displayed, the Service Provider is entitled to cancel the order or to agree with the Customer on the correct price.

12. Right of Withdrawal

The consumer's right of withdrawal is governed by the provisions of Government Decree 45/2014 (II. 26.).

The consumer is entitled to withdraw from the contract within fourteen (14) days of its conclusion without giving any reason, except in cases for which applicable law establishes an exception to the right of withdrawal.

If the gift voucher is delivered to the Customer electronically, and performance begins, with the Customer's prior express consent, before the expiry of the fourteen (14) day withdrawal period, the Customer acknowledges that, upon the commencement of electronic performance, they may lose their right of withdrawal under the conditions set out in applicable law.

The exercise of the right of withdrawal, and the conditions thereof, are in all cases governed by applicable Hungarian and European Union consumer protection legislation.

13. Defective Performance and Warranty for Defects

The Service Provider is obliged to provide its services and products in accordance with applicable law.

In the event of defective performance, the consumer is entitled to the warranty rights for defects set out in the Civil Code.

At the consumer's choice, they may request:

- the correction of the defect;

- the replacement of the service, where possible;

- an appropriate price reduction;

- withdrawal from the contract, where the conditions set out in law are met.

The consumer is obliged to report the defect without undue delay after becoming aware of it.

14. Complaint Handling

The Service Provider pays particular attention to handling any complaints that arise quickly, professionally, and in accordance with applicable law.

The Service Provider investigates the complaints it receives and responds to them in writing within thirty (30) days at the latest.

Complaint handling is free of charge.

The Service Provider keeps records of the complaints received and their handling in accordance with applicable law.

15. Conciliation Board Proceedings and Enforcement of Rights

If a consumer dispute cannot be settled through negotiation between the parties, the consumer is entitled to initiate proceedings before the conciliation board with jurisdiction over their place of residence or stay, or may turn to the board with jurisdiction over the Service Provider's registered seat:

The proceedings and jurisdiction of the conciliation boards are governed by applicable law.

The consumer is also entitled to turn to the courts, as well as to use any other means of enforcing their rights specified by law.

16. Liability

The Service Provider takes all measures that can reasonably be expected of it to ensure that the information published on the website is accurate, up to date, and true.

The information found on the website is for informational purposes only. The Service Provider reserves the right to modify the menu, drink selection, prices, promotions, opening hours, programs, events, and other information without prior notice.

The Service Provider is not liable for damages arising from temporary errors or outages in the operation of the website that occur due to reasons beyond its control, in particular internet network failure, force majeure, power outage, provider malfunction, or failure of third-party systems.

The Service Provider is not liable for damages arising from malfunctions of the User's IT equipment, software, or internet connection.

The Service Provider is not liable for consequences arising from data incorrectly provided by the User.

The Service Provider excludes liability for any damage arising from the User's unlawful, improper use of the website, or use contrary to the provisions of this GTC.

17. Intellectual Property

All content found on the kalozetterem.hu website – in particular texts, images, graphics, logos, videos, animations, design elements, icons, audio material, software, and other copyrighted works – constitutes the intellectual property of the Service Provider or of a third party used with the rightholder's permission.

Any copying, reproduction, modification, distribution, public disclosure, or other use of any content of the website may only take place with the prior written consent of the Service Provider.

Unauthorized use of the trademarks, logos, and brand marks found on the website is prohibited.

This GTC does not grant any right of use with respect to the copyrighted content found on the website.

18. Data Protection

The Service Provider carries out the processing of personal data in accordance with applicable Hungarian and European Union data protection legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), as well as the legislation on the right to informational self-determination and freedom of information.

The detailed rules on the processing of personal data are set out in the Privacy Notice published on the website.

The detailed provisions on the use of cookies are set out in the Cookie Notice published on the website, if and when such a notice is prepared.

Acceptance of this GTC does not substitute for reading and understanding the Privacy Notice and the Cookie Notice.

19. Force Majeure

The Service Provider is not liable for delays or obstacles to performance that occur due to an unavoidable external cause (force majeure).

Force majeure shall include, in particular:

- natural disaster;

- flood;

- fire;

- epidemic;

- act of war;

- act of terrorism;

- strike;

- action by a public authority;

- a national or regional outage of internet or telecommunications services;

- failure of the electrical grid;

- any event that is beyond the Service Provider's reasonable control.

In the event of force majeure, the Service Provider is entitled to modify the time of performance to the extent necessary.

20. Amendment of the GTC

The Service Provider reserves the right to amend these General Terms and Conditions at any time.

The amended GTC takes effect on the date of publication on the website, unless the Service Provider specifies a different effective date.

Amendments do not affect contracts concluded prior to the entry into force of the amendment.

The User is obliged to review the General Terms and Conditions in effect at any given time before using the website.

21. Final Provisions

These General Terms and Conditions are governed by Hungarian law.

For matters not regulated by this GTC, the provisions of, in particular, Act V of 2013 on the Civil Code, Act CVIII of 2001 on Electronic Commerce Services, applicable consumer protection legislation, and directly applicable European Union legislation shall apply.

If any provision of this GTC proves to be invalid or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions.

These General Terms and Conditions have been prepared in Hungarian and are continuously available in electronic form on the kalozetterem.hu website.
